ATS innovates, designs and manufactures the strongest transmission/torque
converter systems on the market. Our warranty is designed to protect the
consumer and ATS. We are the ONLY performance transmission/torque converter
company in the world offering a 5-year, 500,000 mile
warranty. We are also the only company designing and manufacturing a
high-performance transmission/torque that publicly posts its warranty. We
choose to post our warranty online so you can make an educated purchasing
decision — our warranty is that strong.
I would like to make a few additional points:
- All
ATS transmission/torque converter packages come standard with a 5-year, 500,000 mile parts warranty. If the transmission and/or torque
converter is installed by an authorized ATS dealer,
the first year of the warranty also includes labor and shipping in the event of
a failure. Please visit the following web site for authorized

- If
the transmission/torque converter is installed by an authorized ATS dealer, and
there is a failure during the first year of service, ATS will cover the labor
to remove it, ship it to ATS, repair the transmission, ship it back to the
authorized ATS dealer, and have it reinstalled into your vehicle.
- If
the transmission/torque converter is installed by an authorized ATS dealer, the
second through fifth year of warranty carries parts replacement only.
- When
a transmission/torque converter is purchased directly from ATS and installed by
the customer, (or any non-authorized ATS dealer), the transmission warranty is
still 5-years, 500,000 miles. However, shipping and labor are not covered for
the first year of the warranty coverage. If there is a problem with the
transmission/torque converter, simply return the assembly to ATS for diagnosis
and repair. The customer is responsible for all shipping and labor for
installations at non-authorized facilities.
Something that should also be noted is that as
an added benefit, if a warranty repair is required at any time during the
5-year, 500,000 mile warranty period, and your vehicle is delivered to the ATS
manufacturing and installation facility located in Arvada, Colorado, there will
be no labor or removal and installation charges incurred by our customer for
the repair.
One last item that I would like to address:
ATS does not cover broken shafts. Broken shafts are caused from excessive
torque; a shaft is only as strong as the material that it is made of, and the
design of the shaft. No matter how tough, transmission and torque converter
components have their limitations.
ATS Billet Shafts are designed to offer more flex then a factory shaft,
allowing for greatly increased stress cycles and torque capacity. It is, of
course, possible to break a billet shaft. If you happen to break a hard part
(shaft, drum, etc.), even though we don't cover them under warranty, our policy
in this situation is to have the transmission/torque converter shipped back to
ATS so we can assess the damage. We will maintain close contact with you
throughout the process, explain what damage has occurred, and determine the
next steps needed to repair the transmission/torque converter to ATS' specifications,
so your warranty coverage continues. There will be costs associated with
the repair, but the costs are typically limited to the damaged part and any
incidental damage the break caused internally. You will also be
responsible for shipping to, and labor charges, at your shop of choice.
However, if you can bring your vehicle to ATS in Arvada, Colorado, we
will happily perform the removal and replacement of the transmission/torque
converter at no charge to you. We would welcome the opportunity to meet
you and show you our facility while you are here.
I have a personal commitment to our ATS customers to deliver the best designed, most robust, longest lasting, toughest
products that can be made. This commitment does not end after the sale. That is
why we have the 5-year 500,000 mile warranty.

Important
General Provisions
1.
This
warranty does not
cover broken
transmission shafts. If
ATS Diesel Performance determines, through reasonable evidence
and inspection, you have broken a
transmission shaft, hub, or gear set then the Company
reserves the right to refuse coverage under these express
terms.

ATS is NOT RESPONSIBLE OR LIABLE under this Warranty if the customer does not return a required core within
the allotted time. Most items must
be returned within 20 days.
ATS is relieved from any responsibility or liability under this Warranty
on any product for which invoices carry an open balance; i.e.: all bills must
be paid in full and all cores must have been returned before ATS will
even consider a warranty replacement or repair will even be considered by
ATS.
This
warranty may be amended at ATS may amend this warranty from
time to time, at its discretion, ' discretion
from time to time to keep up with changing business conditions and
technology.
In the Event of a Failure
ATS
products generally carry a NEW
FIVE YEAR/FIVE HUNDRED THOUSAND MILE (5 yr/500,000
mile) warranty.
There are several
exceptions, so refer to this warranty's specific
terms and conditions. All
labor, shipping or any other charges associated with the product
and the product's
failure are not covered under warranty.
Labor and/or shipping charges will not be refunded under any
circumstance. After the one-year
anniversary date of the original purchase, there is a limited parts replacement
warranty only.
In
the event of a product's
failure, the customer must return the defective product
to ATS for inspection before a replacement is sent to the customer. After ATS inspects the product
and completes the failure analysis, the inspection officer at ATS will provide
written documentation stating the condition of the product
and determine, to the best of his or her ability, what caused the malfunction
or complaint. Based on the
findings of the inspection report, ATS will decide
whether there is a valid warranty claim.
Should
a customer require immediate service,
and chooses not to wait for their product
to be returned to ATS for inspection, service, and potential repair or
replacement, the customer can purchase a replacement product
from ATS. The
customer must pay the
full current MSRP, the applicable core charge, and shipping to and from ATS'
shop. When the defective product
arrives, ATS will refund the core charge and inspect
the product. During
inspection, ATS will assess the product
for warrantable damage. If the
original product has indeed failed
under the terms of the original warranty, ATS
will refund the full purchase price for the replacement product only. If
the product has failed due to
any issue not covered under the
original warranty, ATS will assess charges to the customer based on any parts
necessary to return the product
to nominal ATS standards. ATS will
deduct the total cost of required parts from the replacement product's purchase
price, and the customer will be refunded the difference (if any) between the
purchase price paid for the replacement product
and the cost of parts.
If
the customer can wait for their product
to be returned to ATS for inspection, service, and potential repair or
replacement, the customer pays
shipping to and from ATS' shop. When the defective product
arrives in Colorado, ATS will inspect the product. ATS will then assess the product
for warrantable damage. If the product
has failed under the terms of the original warranty contract, ATS will repair
or replace the product – at ATS's
discretion. If the product has
failed due to any issue not covered
under the original warranty, ATS will assess charges to the customer based on
any parts necessary to return the product to nominal ATS standards. ATS will bill the customer for the
total cost of parts required for repair of the product,
and shipping to and from Colorado, prior to the repaired/replaced product
being sent to the customer.
ATS Automatic Transmissions
This
section incorporates Section 2,
entitled ÒIn the Event of a Failure.Ó
ATS Aautomatic
Ttransmissions
carry a NEW FIVE YEAR/FIVE
HUNDRED THOUSAND MILE (5 yr/500,000 mile) 3-year/150,000 mile warranty.. This warranty shall
not apply to any automatic
transmission that has been improperly stored or installed. This
warranty shall not apply to misapplication, improper operating conditions,
accidents, or neglect. This warranty
shall not apply to an automatic transmission that has been
improperly repaired, maintained and/or altered by the owner or his
agent/tech. This
includes (but is not limited to) Items 1, 2, and 3 – listed here:
1. Broken,
fractured, or sheared shafts/gears and damaged cases
are not covered under this warranty.
2.
Damage to the front pump due to mis-installation
or misalignment of the torque converter.
3.
Damaged gear train due to insufficient lubrication as a result of:
a. Low fluid level
b. Improperly serviced transmission
c. Modifications to cooler system that is not
approved by ATS (i.e.: external transmission filter, restricted cooler lines)
d. Non-updated snap-in connectors in cooler
lines (Dodge Specific: 94-98.5 must be upgraded to screw-in cooler lines)
ATS
will not pay for any fluids replaced in the event of a transmission
failure. Synthetic fluids are not
covered under any circumstance.
The customer is responsible for the cost of Synthetic ATF.
Most importantly,
all transmission shafts are not covered by warranty on
any transmission due to the capability of certain situations to cause
stress-loads beyond the structural ability of the shaft. ATS'
Automatic Transmission warranty is NOT transferable.All
labor, shipping or any other charges associated with the transmission and the
transmission failure are not covered under warranty. Labor and/or shipping charges will not be refunded under any
circumstance. After the one-year
anniversary date of the original purchase, there is a limited parts replacement
warranty only.
Standard
transmissions do
not carry the same coverage as automatic
transmissions. ATS
warranties their standard transmissions for 12 months/12,000 miles, unless the customer chooses
to purchase ATS' Òtransmission cooler;Ó if so, the standard transmission carries ATS' full
3 year/150,000 warranty.
In the event of a
transmission failure, the customer must return the defective transmission to
ATS for inspection before any replacement transmission is sent to the
customer. After ATS inspects the
transmission and completes the failure analysis, the inspection officer at ATS
will provide written documentation stating the condition of the transmission
and determine, to the best of his or her ability, what caused the malfunction
or complaint. Based on the
findings of the inspection report, a decision will be made as to the validity
of the warranty claim. In the
event of clutch pack failure, see ÒClutch Pack FailuresÓ below.
In the event the
customer requires immediate service and chooses not to wait for their
transmission to be returned to ATS for inspection, service, and potential
repair or replacement, a replacement transmission can be purchased for the full
current MSRP of the transmission, plus applicable core charge, and shipping to
and from ATS' shop. When the
defective transmission arrives at ATS, the core charge will be refunded to the
customer, and the transmission will be inspected. During inspection, ATS will assess the transmission for
warrantable damage. If the
original transmission has indeed failed under the terms of the original
warranty, ATS will refund the full purchase price for the replacement
transmission only. In the event
the transmission has failed due to any issue not covered under the original
warranty contract, ATS will assess charges to the customer based on any parts
necessary to return the transmission to nominal ATS standards. ATS will deduct the total cost of
required parts from the replacement transmission's purchase price, and the
customer will be refunded the difference (if any) between the purchase price
paid for the replacement transmission and the cost of parts. In the event of clutch pack failure,
see ÒClutch Pack FailuresÓ below.

the event the customer can wait for their transmission to be returned to ATS
for inspection, service, and potential repair or replacement, the customer pays
shipping to and from ATS' shop.

Line pressures must be tested at time of install. (This is mandatory
for warranty.) Measure the
following:
1. 1.
Idle line pressure test:
Idle vehicle in Drive. Note pressure and record on the bottom of the
included warranty card to be
sent to ATS.
2. 2.
Stall line pressure test: Place vehicle in drive with emergency
brake on and pump stop brake 3 times. Hold stop brake with left
foot while pressing accelerator to wide-open throttle for 3 seconds. Note maximum pressure and record on the
bottom of the included warranty card to be sent to ATS.
This transmission warranty shall not apply to any
unit that has been improperly stored or installed; or to misapplication,
improper operating conditions, accidents, or neglect; or which has been
improperly repaired, maintained and/or altered by the owner or his agent/tech. This includes, but is not limited to the
following:
1.
Abuse resulting in broken, fractured, or sheared shafts/gears; damaged clutch
packs/bands (except as identified in ÒClutch
Pack FailuresÓ above).
2. Damage to the front
pump due to mis-installation or misalignment of the torque converter.
3. Damaged gear train
due to insufficient lubrication as a result of:
a. Low fluid level
b. Improperly serviced
transmission
c. Modifications to
cooler system that is not approved by ATS (i.e.: external transmission filter,
restricted cooler lines)

4. The use of other than
Factory or ATS TCM/PCM programming.
ATS will not pay for any fluids replaced in the

customer is responsible for the cost of If Synthetic ATF is to be
installed, the customer will be responsible for the cost.
Transmission shafts
are not covered by warranty on any transmission due to the capability of
certain situations to cause stress-loads beyond the structural ability of the
shaft.
ATS' The warranty on
automatic transmission warranty
s is are transferable only by ATS, at
ATS's discretion. Warranty
transfers are for parts only, and do not include first year shipping and/or
labor warranty coverage. The
original owner must contact ATS with the Òtransferee's
contact information
of the Ôtransferee' in order to set up warranty transfer. The transmission may be required to be
returned to ATATSS
may require the customer to return the
transmission to Colorado for inspection prior to warranty
transfer. The customer is
responsible for all labor and shipping charges incurred in the event the
customer decides to have ATS inspect the transmission for warranty
transfer. If, ATS
determines – after inspection – ATS determines that there
are issues with the transmission, we will notify the original owner, who then
has the choice of initiating a warranty claim as outlined above, or having the
transmission returned without repair (customer will be responsible for any
incurred labor charges).
ATS Manual
Transmissions
This
section incorporates Section 2,
entitled ÒIn the Event of a Failure.Ó
ATS manual transmissions carry a three year, one hundred fifty thousand mile (3
yr/150,000 mile)3-year/150,000
mile warranty ONLY if you have purchased and installed the ATS ForceCool Manual Transmission cooler package, otherwise,
ATS manual transmissions carry a 1-year/12,000 mile warranty. ATS will not pay for any fluids replaced in the
event of a transmission failure.All labor, shipping
or any other charges associated with the transmission and the transmission
failure are not covered under warranty.
Labor and/or shipping charges will not be refunded under any
circumstance. After the one-year
anniversary date of the original purchase, there is a limited parts replacement

repair or replacement, the customer pays bi-directional shipping of the
transmission. When the defective
transmission arrives at ATS, the transmission will be inspected. During inspection, the transmission
will be assessed for warrantable damage.
If the transmission has failed under the terms of the original warranty
contract, ATS will repair or replace the transmission, at ATS's discretion. In the event the transmission has
failed due to any issue not covered under the original warranty contract,
charges will be assessed based on parts required to return the transmission to
nominal ATS standards. The total
cost of parts required for repair of the transmission, and bi-directional
shipping, will be billed to the customer prior to the repaired/replaced
transmission being sent to the customer.
This transmission warranty shall not apply to any
unit that has been improperly stored or installed; or to misapplication,
improper operating conditions, accidents, or neglect; or which has been
improperly repaired, maintained and/or altered by the owner or his
agent/tech. This includes, but is

Five Star
Viskus Clutch Drive Torque Converters
This
section incorporates Section 2, entitled ÒIn the Event of a Failure.Ó
Five Star Viskus Clutch Drive Torque Converters (ÒConvertersÓ)
carry a NEW FIVE YEAR/FIVE
HUNDRED THOUSAND MILE (5 yr/500,000 mile)3-year/150,000
mile warranty. ATS' warranty does
not cover Aall
labor, shipping or any other charges associated with the 5Star Viskus Clutch
Drive Torque ConverterConverters,
and the 5Star Viskus Clutch Drive Torque Converter failuree
are not covered under warranty. ATS will not refund Llabor and/or shipping charges will not
be refunded under any circumstance.
After the one-year anniversary date of the original purchase, there is a
limited parts replacement warranty only.
In the event of a torque converter failure, the customer must return the defective
5Star Viskus Clutch Drive Torque Converter tomust
be returned to ATS for inspection ATS before ATS will send
before any replacement 5Star Viskus Clutch Drive Torque Converter
is sent to the customer. After ATS
inspects the Converter the 5Star Viskus Clutch Drive Torque
Converter is inspand completes ected by ATS and tthe failure analysis is completed, the
inspection officer at ATS will provide written documentation stating the Converter's condition
of the 5Star Viskus Clutch Drive Torque Converter and determine, to the best of
his or her ability, what caused the malfunction or complaint. Based on its the
findings, of the inspection report, ATS will decide whether the warranty claim is
valid.a decision will be made as to the validity of the warranty
claim.
In the event the customer requires immediate
service and chooses not to wait for their Converter to be returned to ATS for inspection, service, and
potential repair or replacement, the
customer may purchase a
replacement Converter for
its full current MSRP, plus applicable core charge,
and shipping to and from ATS' shop.
When the defective Converter arrives at ATS, ATS will refund the core charge to the customer and will inspect the Converter.
During inspection, ATS will assess the Converter for warrantable damage. If the original Converter has indeed failed under the terms of the original
warranty, ATS will refund the full purchase price for the replacement Converter only. In the event the Converter has failed due to any issue not covered under the original warranty contract, ATS will assess
charges to the customer based on any parts necessary to return the Converter to nominal ATS standards. ATS will deduct the total cost of
required parts from the replacement Converter's purchase price, and will also refunded
the difference (if any) between the purchase price paid for the replacement Converter and the cost of parts to the customer.
In the event the customer can wait for their Converter to be returned to ATS for inspection, service, and
potential repair or replacement, the customer pays shipping to and from ATS'
shop. When the defective Converter arrives in Colorado, ATS will inspect the Converter. ATS
will then assess the Converter for warrantable damage. If the Converter has failed under the terms of the original
warranty contract, ATS will repair or replace the Converter – at
ATS's discretion. In the event
the Converter has failed due to any issue not covered under the
original warranty contract, charges will be assessed based on parts required to
return the Converter to nominal ATS standards. ATS will bill the customer for the
total cost of parts required for repair of the Converter, and shipping to and from Colorado, prior to the
repaired/replaced Converter being sent to the customer. In the event of clutch pack failure,
see ÒClutch Pack FailuresÓ below.In the
event the customer requires immediate service and chooses
not to wait for their 5Star
Viskus Clutch Drive Torque Converter
to be returned to ATS for inspection, service, and potential repair or
replacement, a replacement unit can be
purchased for the
full current MSRP of the
5Star Viskus Clutch Drive Torque Converter, plus
applicable core charge and bi-directional
shipping. When
the defective 5Star Viskus
Clutch Drive Torque Converter
arrives at ATS, the core
charge will be refunded to the customer, and the
5Star Viskus Clutch Drive Torque Converter will be inspected. During inspection, the 5Star Viskus
Clutch Drive Torque Converter will be assessed for warrantable damage. If the 5Star Viskus Clutch Drive Torque
Converter has failed under the terms of the original warranty contract, ATS
will refund the full purchase price paid by the customer for the replacement
5Star Viskus Clutch Drive Torque Converter. In the event the 5Star Viskus Clutch Drive Torque Converter
has failed due to any issue not covered under the original warranty contract,
charges will be assessed based on parts required to return the 5Star Viskus
Clutch Drive Torque Converter to nominal ATS standards. The total cost of required parts is
deducted from the purchase price paid for the replacement 5Star Viskus Clutch
Drive Torque Converter, and the customer will be refunded the difference (if
any) between the purchase price paid for the replacement 5Star Viskus Clutch
Drive Torque Converter and the cost of parts required for repair.
In the event the customer can wait for their 5Star
Viskus Clutch Drive Torque Converter to be returned to ATS for inspection,
service, and potential repair or replacement, the customer pays bi-directional
shipping of the 5Star Viskus Clutch Drive Torque Converter. When the defective 5Star Viskus Clutch
Drive Torque Converter arrives at ATS, the 5Star Viskus Clutch Drive Torque
Converter will be inspected. During
inspection, the 5Star Viskus Clutch Drive Torque Converter will be assessed for
warrantable damage. If the 5Star
Viskus Clutch Drive Torque Converter has failed under the terms of the original
warranty contract, ATS will repair or replace the 5Star Viskus Clutch Drive
Torque Converter, at ATS's discretion.
In the event the 5Star Viskus Clutch Drive Torque Converter has failed
due to any issue not covered under the original warranty contract, charges will
be assessed based on parts required to return the 5Star Viskus Clutch Drive
Torque Converter to nominal ATS standards. The total cost of parts required for repair of the 5Star
Viskus Clutch Drive Torque Converter, and bi-directional shipping, will be billed
to the customer prior to the repaired/replaced 5Star Viskus Clutch Drive Torque
Converter being sent to the customer.
This warranty shall not apply to any Converter that
has been improperly stored or installed. This warranty shall not apply to
misapplication, improper operating conditions, accidents, or neglect. This warranty shall not apply to a
Converter that has been improperly repaired, maintained and/or altered by the
owner or his agent/tech. This includes,
but is not limited to the followingThis 5Star Viskus
Clutch Drive Torque Converter warranty shall not apply to any unit that has
been improperly stored or installed; or to misapplication, improper operating
conditions, accidents, or neglect; or which has been improperly repaired,
maintained, and/or altered by the owner or his agent/tech. This includes, but is not limited to
the following:
1. Mis-installation
resulting in 5Star Viskus Clutch Drive Torque Converter
hub damage.
2. Stripped bolts or use of bolts other than
those supplied by ATS.
ATS will not pay for any fluids replaced in the event of a 5Star Viskus Clutch Drive Torque Converter
failure. Synthetic fluids are not
covered under any circumstance. If
Synthetic ATF is to be installed, the customer will be responsible for the
cost. ATS' Converter
warranty is not transferable. ATS' Converter warranty is transferable only by ATS, at ATS's
discretion. Warranty transfers are
for parts only and do not include first year shipping and/or labor warranty
coverage. The original owner must
contact ATS with the Òtransferee's contact information in order to set up
warranty transfer. ATS may require
the customer to return the Converter to Colorado for inspection prior to warranty
transfer. The customer is
responsible for all labor and shipping charges incurred in the event the customer
decides to have ATS inspect the Converter for warranty transfer. If ATS determines – after inspection – that
there are issues with the Converter, we will notify the original owner, who then has
the choice of initiating a warranty claim as outlined above, or having the Converter returned without repair (customer will be
responsible for any incurred labor charges)The warranty on 5Star Viskus Clutch Drive Torque
Converters are transferable only by ATS at ATS's discretion. Warranty transfers are for parts only,
and do not include first year shipping and/or labor warranty coverage. The original owner must contact ATS
with the contact info of the Ôtransferee' in order to set up warranty transfer. The 5Star Viskus Clutch Drive Torque
Converter may be required to be returned to ATS for inspection prior to
warranty transfer. The customer is
responsible for all labor and shipping charges incurred in the event the
customer decides to have ATS inspect the 5Star Viskus Clutch Drive Torque
Converter for warranty transfer.
If, after inspection ATS determines there are issues with the 5Star
Viskus Clutch Drive Torque Converter, we will notify the original owner, who
then has the choice of initiating a warranty claim as outlined above, or having
the 5Star Viskus Clutch Drive Torque Converter returned without repair
(customer will be responsible for any incurred labor charges).
Aurora Series Turboc Chargers
This
section incorporates Section 2, entitled ÒIn the Event of a Failure.Ó
Aurora Series Turbo ChargerAurora Series Turbochargerss
(ÒTurbosÓ) carry
a three year, one hundred fifty thousand
mile (3 yr/150,000
mile)3-year/150,000
mile 3-year/150,000 mile non-transferable,
limited parts only replacement warranty. This warranty shall
not apply to any Turbo that has been improperly stored or installed. This
warranty shall not apply to misapplication, improper operating conditions,
accidents, or neglect. This
warranty shall not apply to a Turbo that has been improperly repaired,
maintained and/or altered by the owner or his agent/tech.
All labor, shipping or any other charges associated with the Aurora Series
Turbo ChargerTurbo and the Aurora Series Turbo
ChargerTurbo failure are not covered under
warranty. Labor and/or shipping
charges will not be refunded under any circumstance.
In the event of a failure, the customer must return
the defective Turbo to ATS before ATS will send any replacement Turbo
to the customer. After ATS
inspects the Turbo and completes the failure analysis, the inspection
officer at ATS will provide written documentation stating the Turbo's
condition and determine, to the best of his or her ability, what caused the
malfunction or complaint. Based on
its findings, ATS will decide whether the warranty claim is valid.
In the event the customer requires immediate
service and chooses not to wait for their Turbo
to be returned to ATS for inspection, service, and potential repair or
replacement, the customer may purchase a replacement Turbo
for its full current MSRP, plus applicable core charge, and shipping to and
from ATS' shop. When the defective
Turbo arrives at ATS, ATS will refund the core charge to
the customer and will inspect the Turbo.
During inspection, ATS will assess the Turbo
for warrantable damage. If the
original Turbo has indeed failed under the terms of the original
warranty, ATS will refund the full purchase price for the replacement Turbo only. In the event the Turbo
has failed due to any issue not covered
under the original warranty contract, ATS will assess charges to the customer
based on any parts necessary to return the Turbo
to nominal ATS standards. ATS will
deduct the total cost of required parts from the replacement Turbo's
purchase price, and will also refunded the difference (if any) between the
purchase price paid for the replacement Turbo
and the cost of parts to the customer.
In the event the customer can wait for their Turbo
to be returned to ATS for inspection, service, and potential repair or
replacement, the customer pays shipping to and from ATS' shop. When the defective Turbo
arrives in Colorado, ATS will inspect the Turbo. ATS will then assess the Turbo
for warrantable damage. If the Turbo
has failed under the terms of the original warranty contract, ATS will repair
or replace the Turbo – at
ATS's discretion. In the event
the Turbo has failed due to any issue not covered under the
original warranty contract, charges will be assessed based on parts required to
return the Turbo to nominal ATS standards. ATS will bill the customer for the
total cost of parts required for repair of the Turbo,
and shipping to and from Colorado, prior to the repaired/replaced Turbo
being sent to the customer.In the event of an Aurora
Series Turbo Charger failure,
the Aurora Series Turbo Charger must be returned to ATS for inspection before any
replacement Aurora
Series Turbo Charger is sent
to the customer. After the Aurora Series Turbo Charger is inspected by ATS and the failure analysis is
completed, the inspection officer at ATS will provide written documentation
stating the condition of the Aurora
Series Turbo Charger and
determine, to the best of his or her ability, what caused the malfunction or
complaint. Based on the findings
of the inspection report, a decision will be made as to the validity of the
warranty claim.
In the event the customer requires immediate
service and chooses not to wait for their Aurora
Series Turbo Charger to be
returned to ATS for inspection, service, and potential repair or replacement, a
replacement unit can be purchased for the full current MSRP of the Aurora Series Turbo Charger, plus applicable core charge, and bi-directional
shipping. When the defective Aurora Series Turbo Charger arrives at ATS, the core charge (if applicable)
will be refunded to the customer, and the Aurora
Series Turbo Charger will be
inspected. During inspection, the Aurora Series Turbo Charger will be assessed for warrantable damage. If the Aurora
Series Turbo Charger has
failed under the terms of the original warranty contract, ATS will refund the
full purchase price paid by the customer for the replacement Aurora Series Turbo Charger. In
the event the Aurora
Series Turbo Charger has
failed due to any issue not covered under the original warranty contract,
charges will be assessed based on parts required to return the Aurora Series Turbo Charger to nominal ATS standards. The total cost of required parts is
deducted from the purchase price paid for the replacement Aurora Series Turbo Charger, and the customer will be refunded the difference
(if any) between the purchase price paid for the replacement Aurora Series Turbo Charger and the cost of parts required for repair.
In the event the customer can wait for their Aurora Series Turbo Charger to be returned to ATS for inspection, service, and
potential repair or replacement, the customer pays bi-directional shipping of
the Aurora Series Turbo Charger. When
the defective Aurora
Series Turbo Charger arrives
at ATS, the Aurora
Series Turbo Charger will be
inspected. During inspection, the Aurora Series Turbo Charger will be assessed for warrantable damage. If the Aurora
Series Turbo Charger has
failed under the terms of the original warranty contract, ATS will repair or
replace the Aurora
Series Turbo Charger, at
ATS's discretion. In the event the
Aurora Series Turbo Charger has failed due to any issue not covered under the
original warranty contract, charges will be assessed based on parts required to
return the Aurora
Series Turbo Charger to
nominal ATS standards. The total
cost of parts required for repair of the Aurora
Series Turbo Charger, and
bi-directional shipping, will be billed to the customer prior to the
repaired/replaced Aurora
Series Turbo Charger being
sent to the customer.
Damage due to plugged oil
return lines, thrust bushing/bearing damage due to excessive turboTurbo
surge, and/or lack of supply oil to the cartridge are not covered under this
warranty. ATS' Warranty does not
cover broken Turbo shafts or damage if debris are
sucked into the Turbo's compressor wheel. However, in the event of an uncovered
failure, ATS will inspect the Turbo for damage and charge the customer only for
hard parts replaced.
ATS Diesel Performance Exhaust Manifolds
This
section incorporates Section 2, entitled ÒIn the Event of a Failure.Ó
ATS Diesel Performance Exhaust Manifolds (ÒManifoldsÓ) carry a NEW FIVE YEAR/FIVE HUNDRED THOUSAND
MILE (5 yr/500,000 mile)3-year/150,000 mile
non-transferable, limited parts only replacement warranty. This warranty shall
not apply to any Manifold that has been
improperly stored or installed. This warranty shall not apply to
misapplication, improper operating conditions, accidents, or neglect. This warranty shall not apply to a
Manifold that has been improperly repaired, maintained
and/or altered by the owner or his agent/tech.
ATS Diesel Performance Fuel Injectors
This
section incorporates Section 2, entitled ÒIn the Event of a Failure.Ó
ATS Diesel Performance Fuel Injectors (ÒInjectorsÓ)
carry a ONE (1) YEAR 3-year/150non-transferable,
limited parts only replacement warranty. This warranty shall
not apply to any Injector that has been improperly stored or installed. This
warranty shall not apply to misapplication, improper operating conditions,
accidents, or neglect. This
warranty shall not apply to an
Injector that has been improperly repaired, maintained and/or altered by the
owner or his agent/tech.
Ford 6.0 Injectors must be set to
ATS for inspection in all cases.
After inspection has taken place, ATS will notify the customer of its
coverage. All labor, shipping or any other charges
associated with the Cyclone Series Fuel Injector(s) and the Cyclone Series Fuel
Injector(s) failure are not covered under warranty. Labor and/or shipping charges will not be refunded under any
circumstance.
In the event of a failure, the customer must return
the defective Injector to ATS before ATS will send any replacement Injector to
the customer. After ATS inspects
the Injector and completes the failure analysis, the inspection officer at ATS
will provide written documentation stating the Injector's condition and
determine, to the best of his or her ability, what caused the malfunction or
complaint. Based on its findings,
ATS will decide whether the warranty claim is valid.
In the event the customer requires immediate
service and chooses not to wait for their Injector to be returned to ATS for
inspection, service, and potential repair or replacement, the customer may
purchase a replacement Injector for its full current MSRP, plus applicable core
charge, and shipping to and from ATS' shop. When the defective Injector arrives at ATS, ATS will refund
the core charge to the customer and will inspect the Injector. During inspection, ATS will assess the
Injector for warrantable damage.
If the original Injector has indeed failed under the terms of the
original warranty, ATS will refund the full purchase price for the replacement Injector only. In the event the Injector has failed due to any issue not covered under the original warranty
contract, ATS will assess charges to the customer based on any parts necessary
to return the Injector to nominal ATS standards. ATS will deduct the total cost of required parts from the
replacement Injector's purchase price, and will also refunded the difference (if
any) between the purchase price paid for the replacement Injector and the cost
of parts to the customer.
In the event the customer can wait for their
Injector to be returned to ATS for inspection, service, and potential repair or
replacement, the customer pays shipping to and from ATS' shop. When the defective Injector arrives in
Colorado, ATS will inspect the Injector.
ATS will then assess the Injector for warrantable damage. If the Injector has failed under the
terms of the original warranty contract, ATS will repair or replace the
Injector – at ATS's discretion. In the event the Injector has failed
due to any issue not covered under the original warranty contract, charges will
be assessed based on parts required to return the Injector to nominal ATS
standards. ATS will bill the
customer for the total cost of parts required for repair of the Injector, and
shipping to and from Colorado, prior to the repaired/replaced Injector being
sent to the customer. In the event of one or more injector failures, the
Cyclone Series Fuel Injector(s) must be returned to ATS for inspection before
any replacement Cyclone Series Fuel Injector(s) is/are sent to the
customer. After the Cyclone Series
Fuel Injector(s) is/are inspected by ATS and the failure analysis is completed,
the inspection officer at ATS will provide written documentation stating the
condition of the Cyclone Series Fuel Injector(s) and determine, to the best of
his or her ability, what caused the malfunction or complaint. Based on the findings of the inspection
report, a decision will be made as to the validity of the warranty claim.
In the event the customer requires immediate
service and chooses not to wait for their Cyclone Series Fuel Injector(s) to be
returned to ATS for inspection, service, and potential repair or replacement, a
replacement unit can be purchased for the full current MSRP of the Cyclone
Series Fuel Injector(s), plus applicable core charge, and bi-directional
shipping. When the defective
Cyclone Series Fuel Injector(s) arrives at ATS, the core charge (if applicable)
will be refunded to the customer, and the Cyclone Series Fuel Injector(s) will
be inspected. During inspection,
the Cyclone Series Fuel Injector(s) will be assessed for warrantable damage. If the Cyclone Series Fuel Injector(s)
has/have failed under the terms of the original warranty contract, ATS will
refund the full purchase price paid by the customer for the replacement Cyclone
Series Fuel Injector(s). In the
event the Cyclone Series Fuel Injector(s) has/have failed due to any issue not
covered under the original warranty contract, charges will be assessed based on
parts required to return the Cyclone Series Fuel Injector(s) to nominal ATS
standards. The total cost of
required parts is deducted from the purchase price paid for the replacement
Cyclone Series Fuel Injector(s), and the customer will be refunded the
difference (if any) between the purchase price paid for the replacement Cyclone
Series Fuel Injector(s) and the cost of parts required for repair.
In the event the customer can wait for their Cyclone
Series Fuel Injector(s) to be returned to ATS for inspection, service, and
potential repair or replacement, the customer pays bi-directional shipping of
the Cyclone Series Fuel Injector(s).
When the defective Cyclone Series Fuel Injector(s) arrives at ATS, the
Cyclone Series Fuel Injector(s) will be inspected. During inspection, the Cyclone Series Fuel Injector(s) will
be assessed for warrantable damage.
If the Cyclone Series Fuel Injector(s) has/have failed under the terms
of the original warranty contract, ATS will repair or replace the Cyclone
Series Fuel Injector(s), at ATS's discretion. In the event the Cyclone Series Fuel Injector(s) has/have
failed due to any issue not covered under the original warranty contract,
charges will be assessed based on parts required to return the Cyclone Series
Fuel Injector(s) to nominal ATS standards. The total cost of parts required for repair of the Cyclone
Series Fuel Injector(s), and bi-directional shipping, will be billed to the
customer prior to the repaired/replaced Cyclone Series Fuel Injector(s) being
sent to the customer.
Cyclone Series Fuel Injector(s)
that have utilized Òhome-brewÓ biodiesel,
or any other form of fuel not supplied by conventional means are not covered
under this warranty.
ATS Manual Transmissions
ATS manual transmissions carry a 3-year/150,000
mile warranty ONLY if you have purchased and installed the ATS ForceCool Manual
Transmission cooler package, otherwise, ATS manual transmissions carry a
1-year/12,000 mile warranty. All
labor, shipping or any other charges associated with the transmission and the
transmission failure are not covered under warranty. Labor and/or shipping charges will not be refunded under any
circumstance. After the one-year
anniversary date of the original purchase, there is a limited parts replacement
warranty only.
In the event of a transmission failure, the
defective transmission must be returned to ATS for inspection before any
replacement transmission is sent to the customer. After the transmission is inspected by ATS and the failure
analysis is completed, the inspection officer at ATS will provide written
documentation stating the condition of the transmission and determine, to the
best of his or her ability, what caused the malfunction or complaint. Based on the findings of the inspection
report, a decision will be made as to the validity of the warranty claim.
In the event the customer requires immediate
service and chooses not to wait for their transmission to be returned to ATS
for inspection, service, and potential repair or replacement, a replacement
transmission can be purchased for the full current MSRP of the transmission,
plus applicable core charge, and bi-directional shipping. When the defective transmission arrives
at ATS, the core charge will be refunded to the customer, and the transmission
will be inspected. During
inspection, the transmission will be assessed for warrantable damage. If the transmission has failed under
the terms of the original warranty contract, ATS will refund the full purchase
price paid by the customer for the replacement transmission. In the event the transmission has
failed due to any issue not covered under the original warranty contract,
charges will be assessed based on parts required to return the transmission to
nominal ATS standards. The total
cost of required parts is deducted from the purchase price paid for the
replacement transmission, and the customer will be refunded the difference (if
any) between the purchase price paid for the replacement transmission and the
cost of parts required for repair.
In the event the customer can wait for their
transmission to be returned to ATS for inspection, service, and potential
repair or replacement, the customer pays bi-directional shipping of the transmission. When the defective transmission arrives
at ATS, the transmission will be inspected. During inspection, the transmission will be assessed for
warrantable damage. If the
transmission has failed under the terms of the original warranty contract, ATS
will repair or replace the transmission, at ATS's discretion. In the event the transmission has
failed due to any issue not covered under the original warranty contract,
charges will be assessed based on parts required to return the transmission to nominal
ATS standards. The total cost of
parts required for repair of the transmission, and bi-directional shipping,
will be billed to the customer prior to the repaired/replaced transmission
being sent to the customer.
This transmission warranty shall not apply to any
unit that has been improperly stored or installed; or to misapplication,
improper operating conditions, accidents, or neglect; or which has been
improperly repaired, maintained and/or altered by the owner or his agent/tech. This includes, but is not limited to
the following:
1.
Abuse resulting in broken, fractured, or sheared shafts/gears; damaged
synchronizers.
2. Damage to the input
shaft to mis-installation or misalignment of the clutch.
3. Damaged gear train
due to insufficient lubrication as a result of:
a. Low fluid level
b. Improper fluid type
c. Improperly serviced
transmission
d. Modifications to
cooler system that is not approved by ATS
ATS will not pay for any fluids replaced in the
event of a transmission failure.
Manual transmission shafts and gears are not
covered by warranty on any transmission due to the capability of certain
situations to cause stress-loads beyond the structural ability of the shaft or
gear.
Warranty Term and Labor Coverage for ATS Automatic
Transmissions and Five 5Star
Viskus Clutch Drive Torque ConverterConverters
The product/service warranty shall terminate at the end of the 53-year
anniversary date from the time of original purchase, or 150,000500,000
original miles (whichever occurs first).
How the ATS product was installed and serviced determine the warranty
criteria:
1.
If an ATS Authorized Dealer the
ATS product was installed the product,by
an ATS Authorized Dealer (go to
http://www.atsdiesel.com/ATSWebsite/ FeaturedDealers/
ATSDealerMap.asp for a current listing of ATS Authorized Dealers), the warranty will
cover the following costs up until the first anniversary
of purchase:
- Llabor
(up to $50 an hour, using the warranty repair line from the Mitchell Labor and
Repair Estimating Guide)
- N,
normal ground shipping,
- and
Pparts
costs incurred during the removal, repair, and/or replacement of an ATS product
while undergoing warranty work,
ATS will cover such
costs at theirits
discretion. A
will be covered through the first anniversary of warranty only, based
on ATS discretion, at an n ATS
Authorized Dealer must perform the warranty work,
and may only do so with prior ATS written approval containing an
ATS RMA (Return Merchandise Authorization) number. Until the product has been approved in writing, via an
ATS RMA, for return or repair by ATS at one of the ATS Authorized Dealers, the
consumer will be responsible for all labor, shipping, and any other costs
incurred.
After the first anniversary, at the discretion of
ATS, ATS will cover parts costs only for a total of 5 years or
500,000 miles (whichever occurs first) from the original date of purchase. ATS
will cover such costs at theirits
discretion. The
customer is responsible for aAny labor cost incurred after the first anniversary, as well
as other costs, including shipping charges, unless they purchase the extended
warranty (listed below), are the responsibility of the customer. If ATS determines that a new unit is to
be sent to replace a defective unit, the consumer may be required to purchase
the new unit as stated under specific product sections above.
2. .
If an unauthorized dealer installed the
ATS product was not installed by an authorized dealer, , ATS
will cover parts costs only for a total of 5 years or 500,000 miles (whichever
occurs first) from the original date of purchase. The customer is
responsible for any labor cost incurred after the first anniversary, as well as
other costs, including shipping charges.
Any
labor cost incurred, as well as other costs, including shipping charges, are
the responsibility of the customer.
Warranty Term and Labor Coverage for products other than
ATS Automatic Transmissions, Five 5Star Viskus Clutch Drive Torque ConverterConverters
Any ATS product carrying a product/service warranty
will be specified in the individual product documentation, a copy of which can
be downloaded from the ATS website (http://www.atsdiesel.com). Products not manufactured by ATS Diesel
Performance, Inc. are covered by their manufacturer's Any
products manufactured by ATS which carry a
product/service warranty will be specified in the individual product
documentation, a copy of which can be downloaded from the ATS website
(http://www.atsdiesel.com).
Products not manufactured by ATS Diesel Performance, Inc. are covered by
their manufacturer's warranty and all potential warranty
questions, concerns, or claims should be directed to that manufacturer. All labor, shipping or any other
charges associated with any product warranty are not covered under
warranty. Labor and/or shipping
charges will not be refunded under any circumstance.
ATS' Extended Warranty Terms
As of November 2008, ATS Diesel Performance offers
an extended warranty for all its
products. Please
see attached ÒExtended WarrantyÓ document for details. This extended warranty coverage varies
from product to product, and must be purchased within 90 days of the original
product purchase.
The Ffollowing is NOTnot Ccovered Uunder Wwarranty
ATS is not liable for any towing charges, travel/lodging expenses, lost
wages, business losses, replacement vehicle charges, or any other
resulting charges due to the failure of the component in question. Labor and/or shipping charges are only
covered, for specified items, if an ATS Authorized Dealer has installed the
product and it is within the first year of the warranty OR the customer has purchased ATS' extended warranty under the
terms above.
Aside from provisions set forth in this statement or other ATS warranty
related documents, ATS disclaims any implied warranties of merchantability and
fitness for a particular purpose.
ATS disclaims any liability for incidental or consequential damages
including but not limited to: repair labor, rental vehicles, hotel costs,
emotional distress, or any other inconvenience costs. This warranty is in lieu of all other
warranties or guaranties, either express or implied,
and shall not extend to any consumer or to any person other than the original
purchaser residing within the boundaries of the continental U.S. or Canada.
Service Intervals for ATS Automatic Transmissions and Five
Star Viskus Clutch Drive Torque ConverterConverters
A qualified automotive
shop must service the ATS transmission and/or Five Star
Viskus Clutch Drive Torque Converter every year, or
15,000 miles (whichever occurs
first)In order to ensure warranty for the
full 5 year/500,000 miles. (whichever occurs
first), the transmission and/or 5Star Viskus Clutch Drive
Torque Converter must
be serviced by a qualified automotive
shop every year, or 15,000 miles (whichever
occurs first). Service
includes replacing fluid, filter and gasket. The shop is required tomust
provide the Invoice for the terms provided. Shops may contact ATS if there are any questions on service
intervals and procedures. Customers rs who
are certified technicians must obtain ATS authorization
from ATS before servicing
their ATS product.prior to
performing service operations.
Notification
There are no cash refunds. In the unlikely event the customer is
dissatisfied with one of the products or services provided by ATS, the only
remedy available under the terms of this agreement is to have repair or
replacement services provided under the ATS Diesel Performance warranty, or to
trade products for like ATS manufactured products and services. If the customer attempts a credit card
chargeback on any product purchased from ATS Diesel Performance, the customer
agrees to refund the full amount of the chargeback plus a 50% penalty for the
inconvenience and accounting costs.
In the event the purchaser decides to pursue legal
action towards ATS, for any reason, the parties will mediate in the County of
Jefferson, State of Colorado court.In case any dispute
arises of any nature by customer against ATS (including, but not limited to
warranty claims), such disputes brought by customer must be resolveds
by final and binding arbitration, and not by lawsuit or litigation or
administrative proceeding, in Jefferson County, Colorado, according to the
Commercial Arbitration
Rules of the American Arbitration Association. Customer expressly waives any right to trial
by jury. ATS, however, may sue
customer in Jefferson County/District Court to collect any unpaid accounts, and
customer agrees to jurisdiction and venue of said Courts. All decisions made by a third
party mediator are final. This
warranty gives you specific rights, and you may have other rights, which vary
from state to state.
